Terms of Service - Roar Plunge

These Terms of Service (“Terms”) govern your access to and use of roarplunge.my and any purchase you make from Roar Plunge (collectively, the “Services”). By visiting the Site or buying from us you agree to be bound by these Terms and by all policies that we link to on the Site. If you do not agree, please do not use the Services.

Nothing in these Terms limits any non-excludable rights you enjoy under Malaysian law, including the Consumer Protection Act 1999, the Sale of Goods Act 1957, the Electronic Commerce Act 2006, or other applicable statutes.

1 Eligibility

You confirm that you are at least 18 years old—the age of majority in Malaysia—and have the legal capacity to enter a contract.

If you are under 18, a parent or legal guardian must place the order and will be the contracting party.

2 Orders, Pricing & Payment

All prices are in Ringgit Malaysia (RM) and already include any applicable SST.
Order acceptance occurs only when we email you a written confirmation.
We may refuse or cancel any order—for example, where fraud is suspected, stock is unavailable, or obvious pricing errors exist. If we cancel, we will refund any money you have already paid.
Payments are processed through secure gateways. Credit-card data is always encrypted in transit; other content may travel through networks without encryption.

3 Shipping & Delivery

We provide free delivery within Peninsular (West) Malaysia.
We do not currently ship to East Malaysia (Sabah, Sarawak, Labuan).
Orders are normally dispatched within 2 working days and reach most West-Malaysia addresses in 3–7 working days.
Delivery dates are estimates; delays caused by events outside our control (for example, floods or customs holds) do not constitute breach.

4 Product Information & Availability

Some models are produced in limited runs and may sell out quickly. We aim to display colours and images accurately, but the colour you see depends on your device. Site content is for general information only; it may not always be complete, current, or error-free.

5 Health Disclaimer & Safe Use

Cold-plunge therapy places significant stress on the body and is not suitable for everyone. Consult a registered medical practitioner before use if you have—or suspect you have—any of the following (non-exhaustive list):

Heart or cardiovascular conditions
High or low blood pressure
Diabetes
Respiratory disorders
Pregnancy or are nursing
Any chronic illness or are on medication

The information on this Site is not medical advice. Roar Plunge products are intended only for general wellness and are not meant to diagnose, treat, cure, or prevent any disease. Always have another adult present, keep exposure within the guidelines in the user manual, and exit immediately if you feel unwell.

6 Your Responsibilities

Use all Roar Plunge products strictly according to our manuals and safety instructions. Misuse, negligent set-up, ignoring contraindications, or exceeding recommended parameters voids warranty and is at your own risk.

You must keep your account credentials secure and notify us immediately of any unauthorised use. Provide current, complete, and accurate information and update it promptly.

7 Prohibited Uses

You may not use the Site or its content to:

Break any Malaysian law or regulation
Infringe intellectual-property rights
Harass, abuse, defame, or discriminate
Spread viruses or malicious code
Collect the personal data of others without consent
Spam, phish, crawl, or scrape
Interfere with the Site’s security or normal operation

We reserve the right to terminate your access if you violate this clause.

8 Third-Party Tools & Links

We may offer access to third-party tools (such as payment gateways or courier tracking) “as is” and “as available”. We neither monitor nor control those tools or linked websites and are not responsible for any loss or damage arising from your use of them.

9 User Content

If you send us reviews, ideas, or other material (“User Content”) you grant us a worldwide, royalty-free right to use, reproduce, and adapt that content for any purpose. You remain solely responsible for its legality and accuracy.

10 Personal Data

Your submission of personal data is governed by our Privacy Policy. We collect and process data only for order fulfilment, customer support, and marketing (with consent), and keep it no longer than necessary for these purposes.

11 Errors & Inaccuracies

Information on the Site may contain typographical errors or inaccuracies (e.g., in product descriptions or pricing). We may correct errors, update information, or cancel orders if any Site information is inaccurate, including after you have submitted an order.

12 Warranties & Limitation of Liability

To the maximum extent permitted by law, the Services and all products are provided “as is” and “as available”. We make no express or implied warranties other than those that cannot be excluded under the Consumer Protection Act 1999 (e.g., the guarantee that goods are of acceptable quality).

Product-liability carve-out: Nothing in these Terms limits our liability for death or personal injury caused by our negligence or by a defect in our products, as prohibited by Part X of the Consumer Protection Act 1999.

Except for that carve-out and any other non-excludable rights, we will not be liable for indirect, incidental, special, or consequential loss—including lost profits, revenue, data, or health-related costs—arising from your use of the Services or products. Our total aggregate liability to you for any claim will not exceed the higher of RM1000 or the amount you actually paid for the product in question.

13 Indemnity

You agree to indemnify and hold Roar Plunge (including our officers, employees, and agents) harmless from any claim, demand, loss, or damage—including reasonable legal fees—arising out of (a) your breach of these Terms, (b) your violation of any law or third-party right, or (c) any injury or health issue resulting from your misuse of our products.

14 Severability

If any provision of these Terms is found unlawful or unenforceable, that provision will be severed, and the remainder of the Terms will remain in force.

15 Termination

These Terms remain in effect until terminated by either party. You may terminate by ceasing use of the Site and notifying us. We may terminate if you violate any term. Obligations incurred before termination survive.

16 Entire Agreement

These Terms, together with all policies posted on the Site (including our Refund, Shipping, Warranty, and Privacy Policies), constitute the entire agreement between you and us and supersede all prior agreements.

17 Governing Law & Jurisdiction

These Terms are governed by the laws of Malaysia. You agree to submit to the exclusive jurisdiction of the Malaysian courts.

18 Changes to These Terms

We may amend these Terms at any time by posting an updated version with a new “Last updated” date. Your continued use of the Services after any changes take effect constitutes acceptance of the revised Terms.
